In Spain, there are many different employment contracts depending on the type of work you do. These will adapt to the norms and regulations of your field. These contracts can be summarized in five modalities: open-ended contract, temporary contract, work-experience contract, training and learning contract, and contract for particular projects or services. We will guide you through the differences among them.

  • Open-ended employment contract

As its name suggests, these contracts do not have a termination date and, therefore, the employee will join a company that wants to hire them for a long period of time. This contract is usually offered after several years working in the same company or if the candidate has great experience in similar positions.

You should know that there are different types of this contract: seasonal open-ended contracts (for seasonal activities), open-ended employment contracts for workers with disabilities, and open-ended employment contracts for supporting entrepreneurs (for companies with at least 50 workers).

  • Temporary employment contract

Unlike the open-ended contract, this type of contract has a termination date. It is also known as temporary contract for circumstances of the production and its maximum length is six months, although it can be extended by collective agreement.

Employees with a temporary contract can have a full-time or part-time job, depending on the needs of the position they are offered.

  • Work-experience contract

Once they finish their studies (either in school, university, or postgraduate), the youngster will little working experience will be able to enjoy a work-experience contract. These contracts are used to teach the employee in the field they are specialized in and offer them the opportunity to grow professionally.

This contract cannot be offered to employees who have finished their studies more than five years before the job offer. The salary cannot be lower than the minimum wage and not lower than the 60 % or75 % of the salary of those co-workers doing the same or a similar job.

  • Training and learning contract

This contract is created for young people who are 16-25 years old and don’t have any working experience. Thanks to this contract, employees will learn how to work in a specific field at the same time they receive training during their working hours.

The minimum length is a year, and the maximum is three. After that, the worker will be offered a different type of contract. The training load cannot be more than 75 % of the working hours during the first year and not more than 85 % in the second. The salary will be established in the collective agreement.

  • Contract for works or services

This contract is aimed at employees who will have a very different position than their co-workers since their field is not the usual activity of the company. It normally has a short termination date and cannot be longer than three years.

The job can be full-time or part-time and the salary will be established in the collective agreement.
